What is a supersedeas bond?
A supersedeas bond is a type of judicial surety bond filed by the losing party in a court case to stay execution of a judgment pending appeal. It gives the winning party a financial guarantee that the judgment amount — plus interest and costs — will be paid if the appeal fails.
When is it required?
Under Philippine civil procedure, a judgment creditor may begin execution of the decision once it becomes final and executory. If the judgment debtor intends to appeal, the court may require a supersedeas bond as a condition to pause execution. The bond protects the prevailing party from the risk that the appellant’s assets may become uncollectible during the appeal.
